TERMS OF SERVICE
STREAMLINE EMPIRE LTD (MS CURVACEOUS UK) CUSTOMER PRODUCT & SERVICE AGREEMENT
This Agreement is entered into by and between you (hereafter referred to as the "Customer") and Streamline Empire Ltd (hereafter referred to as the "Company"), trading under the brand name Ms Curvaceous UK. By accepting this Agreement, by ticking a box indicating your acceptance or by purchasing or using our services, you agree to the terms of this Agreement.
1. SERVICES AND PRODUCTS
Streamline Empire Ltd offers a variety of products and services, including but not limited to:
1.1. Online group life coaching sessions targeted at boosting women’s confidence and prospects for success. This service includes regular check-in sessions and access to an online community via our app. Recorded sessions are available for customers to access. This service runs for a duration of 6 months, beginning from the first day of access upon receipt of payment.
1.2. Physical events such as the Curvaceous Icons Masterclass and the Weekender, comprising makeup and fashion classes, modelling training, and participation in photoshoots.
1.3. Standalone masterclasses, photoshoots, and body confidence and modelling workshops. These also include styling and makeup tutorials, and introductions to posing and catwalking.
1.4. Digital courses on makeup, fashion styling, and becoming an influencer, bundled together as the Curvaceous Icons Digital package. This also includes a live virtual session with a professional plus-size model.
1.5. Merchandise.
By participating in these events, you grant Streamline Empire Ltd the right to use any photos or content produced during these events for promotional purposes or any other uses.
2. COMMUNICATION
By providing your contact information to Streamline Empire Ltd, you consent to receive communication from us via mail, social media, email, or phone. You may opt out of promotional communications at any time by clicking the unsubscribe link at the bottom of our emails or by directly requesting to be removed.
3. PAYMENT TERMS AND DISPUTE PROCEDURE
The price and payment plan for each product or service are as stated at the time of sale. All prices are inclusive of VAT where applicable. Failure to meet payment thresholds may result in withholding of services, such as the delivery of photographs.
By making a payment to Streamline Empire Ltd, you acknowledge and confirm that:
You authorize the transaction for the amount stated at the time of the sale.
You understand the terms of the sale, including any and all terms relating to fees, refunds, and termination.
You agree not to falsely dispute the transaction.
In the event of a dispute regarding a transaction, you should first contact Streamline Empire Ltd at info@mscurvaceous.com to attempt resolution. You agree not to file a credit card or debit card chargeback with regard to any purchase without first making a good faith attempt to resolve the dispute directly with us.
Should a chargeback be initiated, you acknowledge and agree that we will provide your payment information, along with any online acceptance of terms and conditions, to the relevant financial institution. If a chargeback dispute is resolved in our favor by the financial institution, we may recover the chargeback amount and any associated fees incurred from you.
4. REFUNDS AND CANCELLATIONS
In accordance with the Consumer Contracts Regulations 2013 in the UK, consumers have the right to cancel a contract for most online purchases within 14 calendar days from the day the contract is concluded. The refund policy varies depending on the type of service or product. If a service or digital course has begun within the 14-day cooling-off period at the consumer's request, and you have accessed any part of the service or digital content, then you will be liable to pay for the first month of the service or the portion of the digital course accessed up to the point of cancellation. For physical events, payments are considered final and non-refundable. All deposits are non-refundable.
5. CANCELLATION OR REFUND REQUEST PROCEDURE
If you wish to cancel your purchase or request a refund, you must provide written notice to info@mscurvaceous.com within the period allowed by law or this agreement. This notice must include detailed reasons for cancellation, a photocopy or digital version of your sales receipt or invoice, your contact details, and if applicable, shipping information for returns. Refunds will be processed within 28 business days of approval, subject to the UK legal requirements.
6. DATE CHANGES
6.1. If you need to change the date for receiving a product or service, written notice must be provided to info@mscurvaceous.com at least fourteen (14) days before the set date of delivery or event. This notice must include the details of the service or product, the original date of delivery or event, and the proposed new date.
6.2. Upon receipt of your notice, we will review the request and notify you whether the date change is possible, considering our availability and scheduling constraints.
6.3. A date change request might incur an admin fee, which will be 20% of the product or service cost, or £79, whichever is lower. This fee is non-refundable even if there are further date changes or cancellations.
6.4. A maximum of two (2) date changes per service or product can be requested. Any request for a date change beyond this limit may not be entertained.
6.5. If a date change is requested 12 weeks prior to the event, this will not incur a date change fee. However, the newly proposed date must be within 12 months of the original date. After 12 months, you may be required to pay a date change fee to attend a future event.
6.6. Date changes for events are subject to availability. If the event is fully booked on the new date requested, you may have to wait until a spot becomes available or choose an alternative date.
6.7. If we change the date of an event, we will waive any date change fees for 12 months.
6.8. In the case of extenuating circumstances, such as serious illness, bereavement, natural disasters, or other events outside of your control, we may, at our discretion, offer a date change free of charge.
6.9. By agreeing to these terms, you accept all responsibility for communicating date change requests in a timely manner and agree to the terms outlined above regarding date change requests.
7. FINANCIAL DIFFICULTY
If you encounter financial difficulties, we are committed to providing support and flexibility where possible, which may include making adjustments or temporarily pausing your plan.
8. EXTENUATING CIRCUMSTANCES
In the event of cancellation due to extenuating circumstances, including but not limited to the COVID-19 pandemic, we do not offer refunds on administrative fees. However, a date change free of charge will be offered.
9. PRODUCT RETURNS
For physical merchandise, products must be returned in their original condition to be considered for a refund within fourteen (14) days. For services and digital content, the specific terms of this agreement will govern any cancellations or refunds. We are not responsible for any damage incurred during shipment of returned products.
10. PHOTO DELIVERY
Delivery of photos or digital content is subject to payment conditions. For packages associated with the Masterclass, photographs from the Day 1 lifestyle photoshoot will be delivered within one month following the receipt of full payment. In the case of Weekender-related packages, photographs from the lifestyle photoshoot will be delivered within one month after 50% of the total payment has been received. Images from the first look of the studio shoot on Day 2 will be dispatched within one month of the receipt of 75% of the full payment. Subsequently, images from the second look of the Day 2 studio shoot will be delivered within one month after complete payment is received.
11. LIMITATION OF LIABILITY
Streamline Empire Ltd shall not be liable for any indirect, consequential or special damages, or for any loss of profits, revenue, or data arising out of or in connection with this Agreement, however caused, and even if such damages are foreseeable or Streamline Empire Ltd has been advised of the possibility of such damages. Streamline Empire Ltd's maximum aggregate liability under this Agreement, whether arising from negligence, breach of contract, or otherwise, shall not exceed the amount paid by you to Streamline Empire Ltd in the twelve (12) month period preceding the event giving rise to the claim.
12. FORCE MAJEURE
Neither party shall be liable for any failure or delay in performance under this Agreement (other than for delay in the payment of money due and payable hereunder) to the extent said failures or delays are caused by events beyond that party’s reasonable control and occurring without its fault or negligence, including, but not limited to, acts of God, acts of government, pandemics, flood, fire, civil unrest, acts of terror, strikes or other labor problems, computer attacks (by government/nation entities or otherwise) or malicious acts, such as attacks on or through the internet, any internet service provider, telecommunications or hosting facility.
13. DATA PROTECTION
We are committed to protecting your privacy and ensuring that your personal information is handled in a safe and responsible way. We will handle and protect your data in accordance with the UK General Data Protection Regulation (UK GDPR).
14. COMPLAINTS PROCEDURE
If you have a complaint, you should email info@mscurvaceous.com with the details of your complaint and wait for a response.
15. TERMINATION
Either party may terminate this Agreement upon giving the other party thirty (30) days prior written notice. In the event of such termination, you shall be obligated to pay for services rendered up to the date of termination.
16. AMENDMENTS
We reserve the right to amend this Agreement from time to time. The updated version will supersede previous versions and will apply to all existing and future agreements.
17. GOVERNING LAW
This Agreement is governed by the laws of the United Kingdom.
